Tamils not in danger of being persecuted in Sri Lanka - IRB Canada

http://marasinghe.com/images/sri-lanka-flag.jpg Canada’s Immigration and Refugee Board, rejecting a refugee claim by a 25 year old Tamil person from Sri Lanka’s Northern Province has said Sri Lanka's political landscape has radically changed over the last 18 months and Tamils are not in danger of being persecuted.


It has said that the changes in Sri Lanka are meaningful and durable and that the claimant's fear of persecution based on his particular social group, perceived political opinion and nationality cannot be accepted.

The IRB has said that “the claimant is not a person in need of protection in that his removal to Sri Lanka would not subject him personally to a risk to his life,” and also has pointed out to improvements in the country’s human-rights situation, among other factors.
A report published in Canada’s “Globe and Mail” says the policy which could affect refugee claimants who arrived in Canada aboard the Ocean Lady and MV Sun Sea, is being challenged in court by a lawyer who says it is not legally sound.

According to the IRB the adjudicators are not expected to follow persuasive decision notes but they are 'encouraged to rely upon in the interests of consistency and effective decision-making.'

Melissa Anderson an IRB spokesman says that each refugee claim, including those made by Tamils from Sri Lanka is determined on its own merits by applying the law to the facts of the particular claim. (niz) Source by: news.lk
